Bandwidth-Sharing Appendix

1. What this Appendix is, and how it applies to you

Etz-Hadaat Machine Learning Services Ltd ("EH", "we", "us") publishes desktop applications that are free to install and use because they bundle third-party bandwidth-sharing software, not because they are free of cost to EH. This Appendix states, in one place, the terms that govern that arrangement for every such application.

This Appendix forms part of the End-User License Agreement ("EULA") of each application listed in Section 2. You accept it when you accept that application's consent screen, which links to this page. Where this Appendix and an application's EULA both address bandwidth sharing, this Appendix governs; on every other subject the application's own EULA and Privacy Policy govern, including their warranty disclaimers, liability caps, governing law, and dispute-resolution terms, which apply in full to everything described here.

2. Applications and vendor covered

This Appendix applies to:

  • Co-Tower — product page, EULA
  • Graph-Agent-UI — product page, EULA

The bandwidth-sharing software currently bundled with these applications is the Honeygain Software Development Kit ("Honeygain SDK"), supplied by Honeygain. Your participation in the Honeygain network and your use of the Honeygain SDK are governed by Honeygain's own terms: Honeygain Terms of Service and Honeygain Privacy Policy.

3. Why these applications are free

EH is compensated by the bandwidth-sharing vendor for SDK usage generated through these applications. That compensation is EH's sole means of monetizing them; EH does not charge you, and does not sell personal information. You do not receive any payment or other compensation for your participation in the vendor's network.

4. What the bandwidth-sharing SDK does

The SDK uses your IP address and your Wi-Fi or mobile internet connection to relay requests on behalf of third-party businesses, for purposes such as web analytics, ad verification, brand protection, and price comparison, as described by the vendor. Once you have consented, it starts automatically each time you launch the application and runs in the background for as long as your consent remains active.

While the SDK is active, part of your internet bandwidth and your IP address are used to carry traffic for third parties you have no relationship with.

5. Consent and revocation

Installing or using a covered application currently requires you to accept both that application's EULA and the bandwidth-sharing consent shown on first run — there is no way to install or use the application without also accepting the SDK. If you revoke consent from the application's tray menu, the vendor session stops, your local consent record is deleted, and the application closes; there is currently no way to keep using it with bandwidth sharing disabled. EH is considering a future version that removes this requirement but makes no commitment or promise as to whether or when that will ship.

If EH changes this Appendix in a way that affects your rights or obligations, the covered applications will ask you to consent again before continuing to run the SDK (see Section 12).

6. Age requirement

The covered applications, and in particular the bandwidth-sharing SDK, are not intended for use by anyone under the age of 18 (or the age of legal majority in your jurisdiction, if higher), and by installing or using them you represent that you meet this requirement. EH does not knowingly permit anyone under this age to enable the SDK. If you believe a minor has installed a covered application or enabled the SDK, contact support@etz-hadaat.xyz and EH will disable the relevant installation's access.

7. Metered and capped connections

The SDK relays traffic continuously in the background whenever it is active, consuming your internet data allowance like any other background application. If you use a metered, capped, pay-per-byte, or mobile/hotspot connection, enabling the SDK may cause additional charges from your internet or mobile provider. By enabling the SDK, you represent that you have checked whether your connection is metered or capped and accept sole responsibility for any resulting data charges. Neither EH nor the vendor reimburses, and both disclaim all liability for, any such charges.

8. Your authority to share this connection

By enabling the SDK, you represent and warrant that you are the account holder for the internet connection the application will use, or that you otherwise have the account holder's or network administrator's permission to use that connection in this way, and that doing so does not violate any acceptable-use policy, contract, or rule imposed by your internet service provider, employer, educational institution, landlord, or other network administrator. You are solely responsible for confirming this before enabling the SDK, and for any consequences — including loss of network or account access, disciplinary action, or contractual liability — if it turns out not to be the case. EH has no liability for such consequences.

9. No warranty against network interference

Relaying third-party traffic through your IP address may cause websites, services, or platforms to rate-limit, CAPTCHA-challenge, temporarily restrict, or block your IP address, or may affect your connection's speed or your IP address's reputation with third-party services, independent of anything you personally did. EH makes no warranty that participation in the vendor's network will not result in these or similar effects, and disclaims all liability for them to the maximum extent permitted by applicable law.

10. Third-party traffic relayed through your connection

The SDK relays traffic on behalf of the vendor's business customers; EH does not select, control, or monitor the content of that traffic and cannot guarantee it will never include abusive, fraudulent, or unlawful use by third parties. If you receive an abuse complaint, notice, subpoena, or inquiry from a third party (including your ISP, a website, or a government authority) relating to traffic relayed through your connection via the SDK, you should direct it to the vendor, whose contact details and policies are linked in Section 2; EH has no visibility into and no liability for the content of relayed traffic.

11. Vendor substitution

EH may replace the bandwidth-sharing SDK named in Section 2 with comparable bandwidth-sharing or monetization software from a different vendor at any time. Doing so is a material change: EH will update Section 2 to name the new vendor and link its terms, and you will be asked to re-consent before the replacement software is enabled on your device.

12. Changes to this Appendix

This Appendix is versioned by the date shown at the top of this page. The covered applications record which version you accepted; when EH publishes a new version, each application shows its consent screen again on next launch and the SDK does not run until you accept. Continuing to use a covered application after accepting a new version means you accept it as amended.

13. Third-party disclaimer

The bandwidth-sharing SDK and network are provided by the third-party vendor named in Section 2, not by EH. Your participation in that network and your use of the SDK are governed solely by the vendor's own Terms of Service and Privacy Policy. EH is not a party to your relationship with the vendor and, to the maximum extent permitted by applicable law, EH makes no representations or warranties of any kind regarding the vendor and accepts no responsibility or liability for the SDK, the vendor's network, their availability, performance, security, or data practices, or for any data usage, charges, loss, damage, or other issues arising out of or related to your participation. Any claims relating to the vendor must be directed to the vendor. To the extent any liability related to the SDK or the vendor's network is not fully excluded by this Appendix, it remains subject to the warranty disclaimers, exclusions, and aggregate liability cap in the EULA of the application you installed.

Nothing in this Appendix limits any non-waivable statutory rights you may have as a consumer under the mandatory law of your country of habitual residence, to the extent such law applies notwithstanding the choice of law and forum in the application's EULA.
